Terms of Service

1. Your Account

To access the Services, you must create an account. You agree to provide accurate, complete, and up-to-date information for your account. You are responsible for maintaining the confidentiality of your API keys and account credentials.

Do not share your API keys or give others access to your account. You agree to immediately notify us if you know or have any reason to suspect that your account or API keys have been compromised.

You are responsible for all activity that occurs under your account, including any usage of your API keys by third parties, whether authorized by you or not.

2. API Usage & Access

GunSpec provides a RESTful API that delivers firearms specification data. Your access to the API is subject to the rate limits and request quotas associated with your subscription tier.

You agree not to exceed your allocated rate limits or attempt to circumvent them. We reserve the right to throttle or suspend access to accounts that consistently exceed their tier limits or engage in abusive patterns of access.

API keys are non-transferable and are licensed to the account holder only. Each API key is tied to a specific subscription tier and may not be shared across organizations without a separate enterprise agreement.

3. Acceptable Use

You agree not to use the Services to: (a) violate any applicable law or regulation; (b) build or contribute to any product or service that facilitates illegal firearms transactions; (c) scrape, crawl, or systematically download data in a manner designed to circumvent the API or replicate the database; (d) attempt to reverse-engineer, decompile, or derive source code from the Services; (e) interfere with or disrupt the integrity or performance of the Services; (f) use the data to create or distribute misleading or harmful content.

We reserve the right to suspend or terminate your access if we reasonably believe you are violating these terms.

4. Intellectual Property

The Services, including the API, documentation, user interface, and compiled database, are owned by Buun Group and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to access and use the data through the API for your permitted purposes.

The individual firearm specifications contained in the database are compiled from publicly available sources. Buun Group claims copyright protection over the database compilation, organization, and enrichment of the data, not over individual publicly known specifications.

You may use data retrieved through the API in your applications, products, and services, provided you comply with these Terms and your subscription tier's usage limits.

5. Data Accuracy

GunSpec strives to provide accurate and up-to-date firearms specifications. However, the data is compiled from various public sources and may contain errors, omissions, or outdated information.

GunSpec does not guarantee the accuracy, completeness, or reliability of any data provided through the Services. You acknowledge that firearms specifications can vary by production run, region, and configuration, and that our data represents typical or published specifications.

6. Paid Services

GunSpec offers subscription plans with varying levels of access and rate limits. Paid subscriptions are billed monthly through Buun Group and automatically renew unless cancelled before the end of the billing period. All payments are processed by Buun Group via Stripe.

You may upgrade or downgrade your subscription at any time. Upgrades take effect immediately. Downgrades take effect at the start of the next billing period.

Refunds are handled on a case-by-case basis. If you believe you have been incorrectly charged, contact us at [email protected] within 30 days of the charge.

We reserve the right to modify pricing with 30 days' notice to existing subscribers. Price changes will not affect your current billing period.

7. Termination

You may terminate your account at any time by cancelling your subscription and deleting your account through the dashboard or by contacting us.

We may suspend or terminate your account if: (a) you violate these Terms; (b) your account has been inactive for more than 12 months; (c) we are required to do so by law; (d) we discontinue the Services.

Upon termination, your right to access the Services ceases immediately. We may retain certain account information as required by law or for legitimate business purposes.

8. WARRANTY DISCLAIMERS

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

GUNSPEC DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. GUNSPEC DOES NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY DATA PROVIDED THROUGH THE SERVICES.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM GUNSPEC SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING THE AUSTRALIAN CONSUMER LAW, IN NO EVENT SHALL BUUN GROUP OR GUNSPEC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY DATA OR CONTENT OBTAINED FROM THE SERVICES; (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA OR API KEYS.

IN NO EVENT SHALL BUUN GROUP'S AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED AUSTRALIAN DOLLARS (AUD $100) OR THE AMOUNT YOU PAID BUUN GROUP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

NOTHING IN THESE TERMS EXCLUDES, RESTRICTS, OR MODIFIES ANY CONSUMER GUARANTEE, RIGHT, OR REMEDY CONFERRED BY THE AUSTRALIAN CONSUMER LAW OR ANY OTHER APPLICABLE LAW THAT CANNOT BE EXCLUDED, RESTRICTED, OR MODIFIED BY AGREEMENT.

10. Indemnification

You agree to indemnify, defend, and hold harmless Buun Group, GunSpec, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your access to or use of the Services; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; (d) any application or service you build using data from the Services.

11. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Australia. Any dispute arising from or relating to these Terms or the Services shall first be attempted to be resolved through informal negotiation.

If informal resolution is not possible within 30 days, either party may pursue resolution through the courts of Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Australia for the resolution of any disputes.

12. Modifications

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date.

Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Services and cancel your account.
